It’s Unconstitutional: UVA Student Files Lawsuit Challenging Handgun Purchase Law

It’s the law. You can buy rifles and shotguns at 18, but for a handgun—it’s 21. It’s the same across most states. In the wake of the Marjory Stoneman Douglas High School shooting last February, some states—like Vermont and Florida—have increased the age limit for all gun sales to 21 years of age. The shooting, which left 17 people dead, spurred another intense wave of anti-gun activism, which has been mostly beaten back. Yet, the anti-gun movement did score some wins with these pieces of legislation, which effectively deprived law-abiding adults the right to bear arms. It’s unconstitutional and yes—that provision in Florida’s law has been challenged, though it’s a lawsuit that’s most likely going to take years to resolve.

In Virginia, a group of recent high school graduates and college students feel that the age limit for the purchasing of handguns at 21 is unconstitutional and are working to file a lawsuit to argue their case. University of Virginia student Tanner Hirschfeld is the lead plaintiff in the legal action against the Bureau of Alcohol, Tobacco, Firearms, and Explosives. The Second Amendment For Young Adults

Plaintiffs include Mr. Tanner Hirschfeld, a University of Virginia undergraduate, as well as Ms. Natalia Marshall, a young woman in Charlottesville, VA. Our attorney, Elliott Harding, is pictured.

 We are young adults in Virginia seeking to challenge the United States federal ban which infringes on our right to purchase common handguns and ammunition from federally licensed firearm dealers (FFLs). We are college students and recent high school graduates between the ages of 18-20 residing in Central Virginia. The federal laws currently allow us to purchase rifles and shotguns from FFLs, but not pistols. Several states are now passing legislation to raise the age to purchase these other firearms. We want to have the ability to purchase handguns, as they are the most traditional forms of self-defense, given their portability, size, and ease to which young men and women can be trained.

Our plaintiffs include local university students and recent high school graduates who are well versed in firearms training. We would rather not have to find family members or friends to purchase these firearms, especially because we want to avoid any sort of “straw man” purchase (which is understandably illegal). The current laws are overbroad, irrational, and have created a system with perverse incentives. We’re already permitted to own these handguns but cannot purchase them through the more prevalent FFLs, which are regulated. Instead, we are left to a more scarce and unregulated private market where there are no background checks, no records, and no accountability. Meanwhile, we continue to have the ability to purchase higher-powered weapons such as shotguns and rifles from these FFLs. We want to be able to purchase and own pistols rather than be limited to the larger weapons which serve different purposes. The law must be struck down so we can defend ourselves.

We’ll see how this works out. On its face, however, I’m always willing to hear cases that could expand Second Amendment freedoms.


How Do We Stop Mass Murder?

After the murders at the Pittsburg Synagogue, I keep seeing this question on Quora; ‘How do we stop mass murder?’

Most of the people asking this question feel strongly about things they don’t understand. They have not studied the issues of physical defense or contemporary mental health. I’m sorry to give them the bad news, but there is no magic button to fix the human condition.

We can not eliminate mass murder, but we can reduce it.

  1. We developed mass murderers after we developed mass media. Stop rewarding narcissistic murderers with a billion dollars of publicity.
  2. Almost all mass murders are in so called “gun-free” zones. Make the government strictly liable for every injury in a government mandated “gun-free” zone.
  3. Make owners/operators strictly liable for every injury in a privately mandated “gun-free” zones.
I’m tempted to add that we should hold bureaucrats responsible for the crazy people they release back into society, but we have never found a way to hold bureaucrats responsible. To claim that as a solution is magical thinking and this isn’t a blog about speculative fiction.
The three things I mentioned won’t end the problem of mass murder, but they will help a lot. If you doubt that conclusion, then please consider this;

Is there any “gun-free” zone where we have not found a gun?
I have not found a single one.

I’ve also heard people propose more background checks and more bureaucratic “no-buy” lists. That sounds too good to be true..and it is. Gun prohibition would disarm an honest citizen like me, but prohibition has not stopped criminals or determined murderers.

The threats range from simple commands for others to kill Trump, to stated desires to kill President Trump, to more detailed fantasies and plans to kill the commander in chief.

A database compiled by Document the Left is ongoing, with more tweets appearing in real time as they are unearthed.

Dem Candidate Calls For Corporate Tax Rate to Be Increased to ’38 or 39 Percent’

Just think what this big of a corporate tax hike will do to any jobs gained with President Trump’s tax cuts.


Kara Eastman, the Democratic candidate in Nebraska’s 2nd Congressional District, said on Sunday that the corporate tax rate should be increased higher than it was prior to Republican tax cuts.

Eastman, who is part of the Democratic Congressional Campaign Committee’s competitive “Red to Blue” program, participated in a debate with incumbent Rep. Don Bacon (R., Neb.), where she slammed tax reform legislation passed by Republicans in the House and Senate and signed by President Donald Trump back in December. She castigated the reform, saying that it was intended to help the wealthy and corporations.

“The fact that the president is now even saying that we need middle class tax cuts shows that that tax bill didn’t cut taxes for the middle class,” Eastman said.

“We need to bring the corporate tax rate back up if not a little bit higher than what it was,” Eastman said. “I would support around 38 or 39 percent.”

Eastman has been an outspoken critic of the tax reform passed by Republicans in Congress, saying back in December that it is “dishonest” and “unpopular.”

“Under this tax bill, the deficit will skyrocket, with $1.5 trillion in debt being added over the next decade. This is tragic news for all Americans who care about fiscal responsibility and government accountability,” Eastman said on Facebook. “Any tax relief this will provide to the middle class is temporary. We should not support these policies. It’s time to vote those who do out of office in 2018!”

A few months after the tax reform was enacted, over 250 businesses offered wage increases, bonuses, and benefits citing tax reform for making this possible, the Washington Free Beaconreported.

The House Majority PAC, which has close ties to House Minority Leader Nancy Pelosi (D., Calif.), was originally scheduled to spend $228,000 on broadcast advertising and $18,000 on cable advertising in the Omaha market during the last couple weeks of October, but they decided to spend the money in Iowa’s 3rd Congressional District.

“Kara outraised her opponent by about $700,000 this quarter, and we have the resources we need to win this district,” Eastman campaign spokeswoman Heather Aliano said. “We are glad to see the House Majority PAC is shifting their resources to where they are needed the most so Democrats can take back the House on Election Day.”



KA-CHING! Kavanaugh Accuser Who Had ‘Nothing To Gain’ Raises Nearly $1 Million, Fields Book Offers

When friendly Democrats questioned Christine Blasey Ford during Brett Kavanaugh’s Senate confirmation hearings to the Supreme Court, they repeated a mantra that she had “nothing to gain” by putting forward accusations that Kavanaugh had fondled her at a drunken high school party 36 years ago.

“You had absolutely nothing to gain by bringing these facts to the Senate Judiciary Committee,” Sen. Dick Durbin said. California Sen. Kamala Harris thanked Ford for her “bravery,” adding “clearly [you] have nothing to gain for what you have done.”

Turns out that was all hooey.

“Ford stands to gain some $1 million and counting from national crowdfunding campaigns launched by friends and other supporters, while she is said to be fielding book offers,” Real Clear Investigations wrote on Monday.

The potential seven-figure windfall, which she says she intends to cash in on – while still asking donors for more money – has some questioning her motivation for accusing the conservative judge after 35 years of silence, and whether it goes beyond personal or even political justice. Others worry the largesse sets a dangerous precedent: Crowdfunding, which unlike political donations is unregulated, could be routinely used in the future as a bounty for providing political dirt on opponents.

Two GoFundMe accounts have raised more than $842,000 for Ford, and the money is still coming in weeks after she testified and left the spotlight. The total does not include a third account collecting $120,000 for an academic endowment in her name.

“The costs for security, housing, transportation and other related expenses are much higher than we anticipated and they do not show signs of letting up,” Ford said in a recent statement posted on the GoFundMe page of the “Help Christine Blasey Ford” campaign, which is still bringing in donations. “Funds received via this account will be used to help us pay for these mounting expenses.”

GoFundMe spokeswoman Katherine Cichy told RealClearInvestigations (RCI) that Ford and her husband “can withdraw as much as they want whenever they want for any purpose. Payments would be electronically deposited into the Fords’ bank account within two to five business days of initiating withdrawals.”

But Ford didn’t have many expenses. All of her legal fees and a polygraph examination were paid for by Democratic attorneys assigned to her by the Democratic members of the Senate Judiciary Committee, RCI wrote. And “panel Democrats were allotted half of a $1 million committee fund for transportation, security, investigations and other expenses associated with the tumultuous confirmation process. The Senate Sergeant at Arms and Capitol Police also provided ‘heightened security’ for Ford.”

Real Clear Investigations reported:

“Her lawyers said they were representing her on a pro-bono basis. Why does she need all of this money?” said an attorney familiar with the committee’s investigation into her allegations, adding that the funds were originally set up to help pay her legal bills.

Piers Morgan can probably be excused for being anti-gun. After all, he’s not American. He’s a British subject, which means he didn’t grow up in the Land of the Free and the Home of the Brave.

However, what he can’t be excused for is continuing to interject himself into the gun debate despite all that. The latest example of his efforts is a simple tweet. It’s enough that I feel like I need to respond, not just for me but for all of us.

To answer your question in the above tweet, about why we don’t just TRY giving up some of our guns to see what happens, I’m afraid that my answer, as an American, is “no.”

The reasons are many, but I’ll touch on a few of them.

For one thing, we’ve tried it. The National Firearms Act of 1934 put heavy restrictions on a number of firearms, basically making it very difficult to obtain certain guns, including machine guns. Guess what happened? Not much of anything. Criminals continued to get the machine guns despite lawmakers’ best efforts.

Then we had the Gun Control Act of 1964 which made it more difficult for people to get guns. It didn’t stop the criminals, mind you, just the law-abiding citizens who jumped through the hoops.

Do you know what we found? We found that when we started to liberalize gun laws, crime actually went down. Now, that’s a correlation and correlation doesn’t equal causation, but if more guns led to more crime, the correlation would have gone the other way. It didn’t. In fact, despite the current anti-gun hysteria, crime rates continue to trend downward.

That alone would have been enough grounds to disagree with you.

However, there’s yet another one, one that I’m sure that you won’t understand as a British subject. After all, many Americans don’t get it either, and that’s how we don’t give up rights because they’re unpleasant or inconvenient. I know that the UK prosecuted a guy for teaching a pug to make a Hitler salute. You guys aren’t huge on rights over there, and a lot of Americans aren’t either, I’m afraid.

But for a lot of us, we jealously guard our rights, especially the right to keep and bear arms. Many of us, myself included, wouldn’t be remotely interested in giving up even some of our guns even if you could demonstrate hard proof that doing so would reduce all crime, not just mass shootings. It’s not because we’re immune to the sorrow people feel after such atrocities, but because we recognize that even if we banned AR-15s outright, there would still be mass shootings. Santa Fe High School should be ample proof of that.

So no, I don’t think we’re going to give up some of our guns.

You have every right to disagree with that, but we don’t care. We’re not subjects, people who forfeit their rights at the whim of Parliment. We’re Americans with rights enshrined and protected in the Constitution.

If you don’t like it, that’s fine, but do consider just going the hell away. We fought an entire war to make it clear that England had no say in American politics, so we don’t really care about your thoughts on the subject.

Don’t go away mad, Piers. Just go away.

Actor James Cromwell warns of ‘blood in the streets’ if Democrats don’t win election

Character actor James Cromwell was honored at the fourth annual Carney Awards, where he used his platform to call for change in the United States and warn of violence if President Trump and his allies remain in office.

Cromwell, a noted character actor known for roles in projects such as “Babe,” “The Green Mile,” “Big Hero 6,” “Boardwalk Empire” and “American Horror Story,” is also a political activist who has worked with organizations such as the People for the Ethical Treatment of Animals. He’s frequently been arrested for his role in planned, peaceful protests at places like SeaWorld and a nuclear power plant in New York.

Speaking to Variety at the event, he warned of the turn that he sees America taking and cautioned there will be “blood in the streets” if Republicans remain in control.

“This is nascent fascism. We always had a turnkey, totalitarian state — all we needed was an excuse, and all the institutions were in place to turn this into pure fascism,” Cromwell said. “If we don’t stop [President Trump] now, then we will have a revolution for real. Then there will be blood in the streets.”

The star, who previously played George H.W. Bush in Oliver Stone’s “W,” echoed these sentiments during his acceptance speech, where he warned that he believes the country is headed toward the possibility of a violent revolution.

“We’re living in very curious times, and something is coming up which is desperately important to this country and to this planet, and that is an election, in which hopefully in some measure we are going to take back our democracy,” he said. “We will have a government that represents us and not the donor class. We will cut through the corruption, [and] we won’t have to do what comes next, which is either a non-violent revolution or a violent one, because this has got to end.”

Comedian Patton Oswalt hosted the event, which honored fellow character actors such as Joe Morton, Jessica Walter, Joe Pantoliano, Bruce Greenwood and M. Emmet Walsh.


Death Threats, Assaults, Vandalism: over 40 Acts of Left-Wing Thuggery in October, So Far…

Left-wing activists and organized mobs have committed some 40 acts of violence and thuggery against President Trump and his supporters in October, and there are still two days to go.

The left’s wanton acts of violence, vandalism, harassment, bullying — combined with the establishment media’s defense and justification of same — more than doubled the 16 recorded acts in September and 18 acts in August.

Contributing to this threatening atmosphere of violence is, of course, the looming midterm elections and the bitter fight to confirm Brett Kavanaugh to the Supreme Court.

While the establishment media attempt to pin the appalling crimes of a serial criminal and vehement Trump hater on Trump and his supporters (an act that will only gin up more hate and violence against Trump and his supporters), throughout the country Republicans are facing organized acts of criminality and harassment at the rate of nearly 1.5 per day.

Trump: End birthright citizenship for some US-born babies


This is an issue that should have been fixed a long time ago but not one President had that guts to address it before President Trump.

WASHINGTON (AP) — President Donald Trump is making another hardline immigration play in the final days before the midterm elections, declaring that he wants to order an end to the constitutional right to citizenship for babies born in the United States to non-citizens. Most scholars think he can’t implement such a change unilaterally.

With seven days to go before high-stakes elections that he has sought to focus on fearmongering over immigration, Trump made the comments to “Axios on HBO.” Trump, seeking to energize his supporters and help Republicans keep control of Congress, has stoked anxiety about a caravan of Central American migrants making its way to the U.S.-Mexico border.

His administration announced Monday it was dispatching thousands of active-duty troops to the border, and Trump said he’d set up tent cities to house asylum seekers.

Trump has long called for an end to birthright citizenship, as have many conservatives. An executive order would spark an uphill legal battle for Trump about whether the president has the unilateral ability to declare that children born in the U.S. to those living here illegally aren’t citizens. Most scholars think he can’t.

Asked about the legality of such an executive order, Trump said, “they’re saying I can do it just with an executive order.” He added that “we’re the only country in the world where a person comes in and has a baby, and the baby is essentially a citizen of the United States.” A 2010 study from the Center for Immigration Studies, a group that supports immigration restrictions, showed that 30 countries offered birthright citizenship.

The Pew Research Center found in a survey published two years ago that births to “unauthorized immigrants” were declining and accounted for about 1 in 3 births to foreign-born mothers in the U.S. in 2014. About 275,000 babies were born to such parents in 2014, or about 7 percent of the 4 million births in the U.S. that year, according to Pew estimates based on government data. That represented a decline from 330,000 in 2009, at the end of the recession.

The president said White House lawyers are reviewing his proposal. It’s unclear how quickly he would act and the White House did not provide further details.

A person familiar with the internal White House debate said the topic of birthright citizenship had come up inside the West Wing at various times over at least the last year, but has some internal detractors. White House lawyers have debated the topic, and expect to work with the Justice Department’s Office of Legal Counsel to develop a legal justification for the action. It is one of many immigration changes being discussed including asylum law changes, and barring the migrant caravan from entering the country.

But administration officials said there would likely be no decisions until after the midterms, due in part to the president’s trip to Pittsburgh Tuesday to meet with victims of the deadly synagogue shooting.

Legal experts questioned whether Trump has the authority to do this by executive order.

Omar Jadwat, director of the Immigrants’ Rights Project at the American Civil Liberties Union in New York, said Tuesday that the Constitution is very clear.

“If you are born in the United States, you’re a citizen,” he said, adding that it was “outrageous that the president can think he can override constitutional guarantees by issuing an executive order,

Jadwat said the president has an obligation to uphold the Constitution. Trump can try to get Congress to pass a constitutional amendment, “but I don’t think they are anywhere close to getting that.”

“Obviously, even if he did, it would be subject to court challenge,” he added.

Suzanna Sherry, a professor of law at Vanderbilt Law School specializing in constitutional questions, said those advising Trump that he can change the Constitution via executive order are simply mistaken. “He can’t do it by himself and, in fact, he can’t do it even if Congress passed a statue.”

“I think it would take a Constitutional amendment,” she said. “I don’t see it as having any plausible legal basis,” she said.

But others suggest the president may have an opening.

Jon Feere, a senior adviser at Immigration and Customs Enforcement, is among those who has long argued that that the president could limit the citizenship clause through executive action.

“A president could direct his agencies to fall in line with his interpretation of the Supreme Court’s rulings, which are arguably limited to children of permanently domiciled immigrants (the court has never squarely ruled on children born to tourists or illegal aliens). He could direct his agencies to issue Social Security numbers and passports only to newborns who have at least one parent who is a citizen or permanently domiciled immigrant,” he wrote in 2015 in an op-ed in the Hill.

In the final days before the Nov. 6 midterms, Trump has emphasized immigration, as he seeks to counter Democratic enthusiasm. Trump believes that his campaign pledges, including his much-vaunted and still-unfulfilled promise to quickly build a U.S.-Mexico border wall, are still rallying cries for his base and that this latest focus will further erode the enthusiasm gap.

Trump voiced his theory that birthright citizenship could be stripped during his campaign, when he described it as a “magnet for illegal immigration.” During a 2015 campaign stop in Florida, he said: “The birthright citizenship – the anchor baby – birthright citizenship, it’s over, not going to happen.”

The Citizenship Clause of the 14th Amendment states: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.”

The amendment was passed by Congress in 1866 during the period of Reconstruction after the Civil War. It was ratified in 1868 by three-fourths of the states. By extending citizenship to those born in the U.S., the amendment nullified an 1857 Supreme Court decision (Dred Scott v. Sandford), which ruled that those descended from slaves could not be citizens.

In addition to the debate over Trump’s authority to declare that children born in the U.S. aren’t citizens, a separate question is whether Congress could pass a law to that effect, or whether only a constitutional amendment could accomplish Trump’s apparent aim of denying citizenship to U.S.-born children of those here illegally.

Republicans in Congress continue introducing bills to end birthright citizenship, including legislation this session from conservative GOP Rep. Steve King of Iowa who has aligned himself with some nationalist political leaders abroad. King’s bill has almost 50 co-sponsors in the House. King’s legislation though would likely face a cool reception in the Senate where there is no companion bill pending, and a handful of senators supported past efforts.

King said he had not discussed the issue with the president at any length in recent months, but that it had come up “in passing” several times in group discussions. He said he hadn’t personally considered birthright citizenship to be part of the caravan issue and applauded the president for connecting the issues.

“Sending this message out, it’s another component of saying to the caravan: Don’t come in here. Some are pregnant, no doubt,” he said.

Sen. Lindsey Graham of South Carolina, now a close ally of the president, also tweeted his support for the change.

“This policy is a magnet for illegal immigration, out of the mainstream of the developed world, and needs to come to an end,” he said.
